The examination of asylum applications is one of the most important tasks performed by the Federal Office for Migration and Refugees (BAMF). This is a responsible, demanding task, given that decisions are taken on people, in complex procedures, taking diverse competences and stringent legal frameworks into account.

This brochure will provide you with an overview of the most important aspects of the asylum procedure, such as applicants’ personal interview, the steps taken in the decision-making process, recent activities to optimise procedures, as well as the place which the activities take up within a European context.

The brochure "The stages of the German asylum procedure" describes the procedure as per October 2016.

There has since been a change to the procedure: the so-called "cluster procedure" no longer applies (see p. 29).

The following amendment additionally applies to family reunification for persons entitled to subsidiary protection (see p. 21): As of 1 August 2018, family reunification from immediate family members to beneficiaries of subsidiary protection will once again be possible. However, this will be limited to a quota of 1,000 people per month.

Humanitarian reasons are crucial
The new regulation does not include a legal right to family reunification. The authorities are supposed to decide on humanitarian grounds who will be granted a residence permit. These include the duration of separation, the age of the children or serious illnesses and specific hazards in the country of origin. In addition, integration-related aspects must also be taken into account. Spouses, minor children and parents of minors can apply for family reunification. Siblings do not have any such rights. Family reunification will also be excluded for marriages entered during the flight process.
Section 36 a of the Residence Act provides the legal basis for the new regulation on family reunification.
