The Advisory Board for Migration of Researchers and Skilled Workers supports the Federal Office for Migration and Refugees in its tasks in the area of skilled labour immigration and research migration.

The Advisory Board consists of twelve honorary members from science, business and administration, who are appointed to the Advisory Board by the President of the Federal Office for three years. The members are appointed on the recommendation

  • of the Federal Ministry of Education and Research or a body appointed by it,
  • of the Federal Council,
  • of the German Rectors' Conference,
  • of the German Research Foundation e.V.,
  • of the Federal Foreign Office or a body designated by it,
  • of the Federation of German Industries and the Confederation of German Employers' Associations,
  • of the German Trade Union Confederation,
  • of the Association of German Chambers of Industry and Commerce,
  • of the Federal Ministry of Labour and Social Affairs or a body appointed by it,
  • of the Federal Ministry of Economics and Climate Protection or a body appointed by it,
  • of the German Academic Exchange Service.

The Chair of the Advisory Board is appointed directly by the President of the Federal Office for Migration and Refugees (BAMF). Since 2019, this has been Prof Dr Daniel Thym, holder of the Chair of Public Law, European and International Law at the University of Konstanz.

The office of the Advisory Council for Migration of Researchers and Skilled Workers was established at the Federal Office for Migration and Refugees, Department 72A.


Responsibilities of the Advisory Board

On 18 November 2023, the previous Advisory Board for Research Migration became the Advisory Board for Migration of Researchers and Skilled Workers and its advisory mandate was expanded to include the area of skilled immigration (amendment of Section 38d Residence Ordinance by Article 4 of the Ordinance on the Further Development of Skilled Labour Immigration of 31 August 2023).

Since then, the Advisory Board has had the following tasks in particular:

  • To make recommendations for general guidelines on the recognition of research institutions,
  • to advise the Federal Office in general and when reviewing individual applications on research issues,
  • to determine whether the need for foreign researchers is adequately covered by the application of the procedure regulated in Section 18d of the Residence Act and Sections 38a-f of the Residence Ordinance,
  • to identify any undesirable developments in connection with the procedure set out in Section 18d of the Residence Act and Sections 38a-f of the Residence Ordinance and, in doing so, to highlight any abuse phenomena or administrative and other obstacles related to migration issues in the recruitment of foreign researchers,
  • to advise the Federal Office for Migration and Refugees in the fulfilment of its tasks in the immigration of skilled workers.

Annual reports

The Advisory Board reports to the President of the Federal Office for Migration and Refugees at least once per year on the performance of its tasks.

At the core of the reports is a presentation of the key areas on which the Advisory Board focused in the period under report and on which it was actively consulted or submitted recommendations. The reports are available in German.
